These Terms of Use ("Terms") govern your access to and use of the website, our mobile applications (the "App"), and any other services provided by TripHost HQ ("Company", "we", "us", or "our"). By accessing or using the App or services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the services.2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into contracts to use the App and services. If you are accessing the App from outside the U.S., you are responsible for compliance with local laws.3. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or internal business purposes. All rights not expressly granted are reserved by the Company.4. User Accounts
To access certain features, you must create an account. You agree to (a) provide accurate, current, and complete information; (b) maintain and promptly update your account information; and (c) maintain the confidentiality of your account credentials. You are responsible for all activities under your account.5. Payments & Subscriptions
If the App or services include paid features, you authorize us (or our payment processors) to charge your payment method. Subscription fees are billed in advance and are non-refundable except as required by law or as otherwise specified. You are responsible for all taxes related to purchases unless we explicitly state otherwise.6. User Content
"User Content" means any content you submit or upload to the App (ride logs, notes, photos, comments, etc.). You retain ownership of your User Content, but by submitting it you grant us a worldwide, non-exclusive, royalty-free license to use, copy, display, and otherwise process it to provide the services. You represent and warrant that you have the rights necessary to grant this license and that your User Content does not infringe third-party rights.7. Prohibited Conduct
You agree not to: (a) use the App for unlawful purposes; (b) attempt to access accounts you are not authorized to access; (c) reverse engineer or tamper with the App; (d) upload malware; or (e) interfere with other users' access to or enjoyment of the services.8. Third-Party Services
The App may contain links to third-party websites, services, or integrations. We do not control those third parties and are not responsible for their content, privacy practices, or terms. Your use of third-party services may be subject to additional terms and privacy policies.9. Intellectual Property
All content, trademarks, logos, and other intellectual property on the App (excluding your User Content) are owned or licensed by the Company. You may not use the Company's trademarks without our prior written consent.10. Disclaimers
The App and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, and non-infringement.11. Limitation of Liability
To the maximum extent permitted by law, in no event will the Company, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App. Our aggregate liability for claims related to the App or services will not exceed the greater of $100 or the total fees you paid to us in the 12 months preceding the claim.12. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its affiliates from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the App.13. Termination
We may suspend or terminate your account or access at any time for violation of these Terms or for other legitimate business reasons. Upon termination, your license ends and you must stop using the App. Sections that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive.14. Dispute Resolution; Arbitration
Unless you opt out within 30 days of first accepting these Terms by sending an email to [email protected] (you can’t opt out later), you and the Company agree to resolve disputes through binding arbitration on an individual basis under the Federal Arbitration Act, in lieu of suing in court. This includes a waiver of any right to a jury trial. The arbitrator may award the same damages and relief as a court. You and the Company also agree to waive any right to participate in a class action or class arbitration.15. Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to its conflict of law rules. If any provision is found unenforceable, the remainder will remain in effect.16. Changes to Terms
We may modify these Terms from time to time. If material changes are made, we will provide notice via email or in-app notice. Continued use of the App after notice constitutes acceptance of the updated Terms.17. Export Controls
